Electronic Conveyancing
We do not assume that you know what happens next. We do however make sure that we keep you in the loop every step of the way whether buying, selling or re-financing property. Our experience allows us to provide you with specialised property advice based on your individual circumstances. We treat each conveyance or transfer of property as an individual transaction.
We use electronic signing of documents online which takes just minutes and eliminates the need to print, sign and return contracts by post or in person.
Wills/Estate Planning
It is important to receive proper legal advice to ensure that the future of your loved ones is protected.
We assist you in obtaining a grant of probate or letters of administration if the deceased died without leaving a will.
We look forward to working with you to minimise any tax payable by your estate as well as determine whether your loved ones would benefit more by appointing trustees to manage your assets after you die or lose capacity instead of leaving it to family directly.
Leases
At Smooth Legal we can assist you by drafting or reviewing a lease, negotiating lease terms and fixtures and fit-out costs, drafting sub-leases and disclosure statements for lessors and registering a lease.
We can also assist you with varying the existing terms of a current lease and drafting sub-leases.

Easements- Your Rights
Sometimes a neighbour adjacent to your property may have certain rights to use your land in a way that benefits them. These rights are known as easements or rights of way and are usually registered on the title of a property. However, sometimes an easement or right of way, may become enforceable if someone uses part of your property even when they do not have a legal entitlement to do so. Without proper legal advice you would not be aware of any entitlement either granted or obtained by another person to use your land.
First Home Owner Grant
If you and your spouse or partner are Australian citizens or permanent residents who have never owned residential property in Australia and you enter into a contract to purchase newly built residential property in New South Wales, then you may be eligible to receive $10,000 by way of grant if the purchase price of your new home is no more than $600,000.
If you are an owner of land who enters a building contract to build a new property you may also be eligible for the $10,000 grant.
First Home Buyer Assistance Scheme
Unlike the First Home Owner Grant you do not need to buy a “new” property to be entitled to a concessional rate of stamp duty or an exemption from paying stamp if the value of the property you are intending to purchase has a value between $650,000 and $800,000.
If your property is valued at less than $650,000 then you could be eligible to apply for a full exemption for stamp duty. Contact us to see whether you are eligible for a full exemption for stamp duty.
